Role of Isle Inn Tours

Tara Travel Holdings, doing business as Isle Inn Tours (we/us/our/the company) are sales agents in the business of facilitating travel reservations/arrangements, and payment thereon – the trip/tour/vacation.  We do not own, manage, maintain, or otherwise control any of our suppliers including airlines, hotels, ground transportation, tour operators, attractions, cruise line, bus/coach operator, venues, food service operation, or any other business named in your itinerary and we are not responsible for their actions, omissions, or failures to adhere to timetables or to operate on the schedule or plan proposed nor do we have any liability stemming from their failure or financial default.

You acknowledge and accept that our liability is limited to the amount paid to us.

By signing our reservation form, making your deposit, paying in full, or clicking “I Agree” on our website, you hereby agree to the following terms and conditions, on behalf of yourself and all members of your traveling party.

Tara Travel Holdings d/b/a Isle Inn Tours (“we” or “us”) arranges the tour described in the brochure and your itinerary.

Entering Into Agreement

By directing Isle Inn Tours to place travel reservations for you and/or by making an initial payment against any invoice or itinerary, you acknowledge that you have read, understand, and agree to these Terms and Conditions and that you have expressed the terms and conditions to all members of your travel party and received their acceptance of our Terms and Conditions.

 

Changes to Terms and Conditions

Changes to the Terms and Conditions may be made from time to time and become effective immediately.  Should such changes be deemed material in nature, we will notify you.  Your continued use of our services represent an acceptance of our Terms and Conditions in place at the time of your departure or cancellation.

 

Travel Insurance

We STRONGLY urge you to purchase a travel protection plan.   Unanticipated circumstances arise regularly and we are restrained in our ability to mitigate any loss or risk and/or provide refunds, alternate accommodations, or credits.  Your insurance coverage/plan should include coverage of all non-refundable trip elements, medical assistance and evacuation, trip interruption, lost baggage/personal affects.

By entering into this agreement, you acknowledge that you have been advised to purchase travel insurance.  Should you suffer a financial burden associated with your trip, you alone are personally responsible for any and all loss, damage, or additional expense including loss or expense stemming from (i) lost/misplaced/delayed baggage, medication, and/or documents (Passport/travel documents/papers) (ii) flight cancelation or delay that may cause a loss of unutilized trip features and related expenses that will not be reimbursed by us; (iii) if you or someone in your party become ill or otherwise unable to travel due to illness, condition, or limitation we will not be able to make a refund; (iv) if a natural disaster or any Force Majeure interrupts your trip or transportation or accommodation, and or leaves you stranded; (v) civil unrest, act or threat of terrorism, health restriction including quarantine, restricted movement; (vi) any act of theft or criminal offense.

 

Traveler Responsibility

It is the responsibility of each individual traveler to provide us with your proper name, including proper spelling and or other conditions.  Names for airline transportation must match exactly with the details on your Passport.  You agree that you have confirmed that your Passport is valid for travel, any health requirements have been adhered to.

Note – typically your Passport must be valid for a minimum of six months AFTER the end date of your trip.

Fitness to Travel

Travelers and/or tour participants should notify Isle Inn Tours of any limitation of mobility, diet, or other factor prior to the commencement of the tour. 

 

Inherent Risk

Risks of Travel And Release: We (Tara Travel Holdings doing business as Isle Inn Tours, our agents, employees, share-holders, managers, officers, directors, affiliates) assume no responsibility for and shall not be liable for the acts or omissions on the part of any other party not under our control or any acts of God, acts of nature, Force Majeure, unsafe conditions, terrorism, health hazards including pandemics, illness, weather hazards, industrial or trade/union actions or the suitability for a disabled person of any portion of any trip. We have no special knowledge of dangers during travel or at destinations. For information related to such dangers, we recommend going to the State Department travel website at www.travel.state.gov, click on “Find International travel Information” then click on “Country Information”, and fill in the name of the destination country. For medical and health information, we recommend going to the Centers for Disease Control website at www.cdc.gov/travel, then click on “Destinations” and scroll to the name of the destination country. YOU HEREBY EXPRESSLY ASSUME ALL OF THESE RISKS AND DANGERS, AND YOU HEREBY EXPRESSLY AGREE TO FOREVER RELEASE, DISCHARGE AND HOLD US, AND OUR AGENTS, EMPLOYEES, OFFICERS, DIRECTORS, ASSOCIATES, AFFILIATED COMPANIES, GUIDES, GROUP LEADERS, AND SUBCONTRACTORS HARMLESS AGAINST ANY AND ALL LIABILITY, ACTIONS, CAUSES OF ACTIONS, SUITS, CLAIMS, AND DEMANDS OF ANY AND EVERY KIND AND NATURE WHATSOEVER WHICH YOU NOW HAVE OR WHICH MAY HEREAFTER ARISE OUT OF OR IN CONNECTION WITH THE TOUR OR PARTICIPATION IN ANY ACTIVITIES IN WHICH YOU PARTICIPATE.

 

Payment Schedule

The payment schedule for each transaction will be set forth in the documentation provided, including any specific dates and conditions for payment.  Group travel payment schedules can be found on our website under the group tour itinerary description. 

Advertised price is valid at time of publication and subject to change without notice, prices vary due to limited availability, previous purchase, seasonality, sell-out, price increase, currency fluctuation and other variables.

 

Refunds

Placing Reservations and Initial Payment

You agree that the initial payment made to us is for work already completed on your behalf and at your request and includes the procurement of travel products and services, reservations, itinerary consultation, and any and all other work and preparations related to presenting your trip plan and/or invoice. 

For group travel, you acknowledge and agree that by directing Isle Inn Tours to hold a place for you on a group tour, that you have caused space on such tour to be withdrawn from limited and perishable inventory that may not be possible to resell.  

 

Refund Eligibility

Different tour elements have varied refund terms.  Airline tickets are generally non-refundable once issued.  Credits may be offered by the airline.

“No Shows” are not eligible for refund but may “catch-up” with the tour at their own expense.  Leaving the trip early constitutes a “no show” for purposes of refund.  Any unused element of the trip is not eligible for refund.

Refund Schedule

If not otherwise specified in your proposal, the following will apply.

In addition to any airline penalties imposed and a processing fee of $750 per person, the following penalties apply to all customers that must cancel reservations:

Name Change

Name changes may be accommodated for hotel and ground transportation arrangements.  A name change fee of $250 per name changed will apply once documents have been issued. 

Airlines will consider a name change the same as a cancellation and a new ticket must be purchased at the expense of the traveler.

Please consider TRAVEL INSURANCE to mitigate possible loss due to name change.

 

Cancellation and Change by Isle Inn Tours

Should we have to cancel or change your tour for any reason, we will do so as early as possible in advance of your trip in similar type and style as available.  We reserve the right to make changes at any time to the itinerary and or accommodations and may do so once the tour has begun due to circumstances beyond our control.

Should a tour leader fail to reach the minimum number participants to conduct a particular tour, the tour may be cancelled or the price increased.  In the event of cancellation by Isle Inn Tours, a full refund will be made.

Should your check be returned by the bank for any reason, any charges, fees, etc. will be the responsibility of the check maker.  Checks lost, misplaced, or otherwise not delivered to Isle Inn Tours and any expense related to failure to be delivered are the responsibility of the maker.

Credit Card

You may use your credit card to make payment.  By providing your credit card number either directly into our online application or by other means (phone, e-mail, etc.) you acknowledge and agree that you authorize us to charge your card and to do so without your written signature. 

We are the merchant on your credit card transaction. Please bear in mind that our services consist only of facilitating the sale and paying the Suppliers. If a Supplier does not provide the service or ceases operations, your recourse is against the Supplier, not us. You agree not to initiate a chargeback against us or a refund request that is not authorized by this agreement and to pay any and all legal fees incurred by us in disputing any such claim for refund.  By using your credit card, you accept and acknowledge that any fee imposed by the credit card processor and not returned to us will not be refunded under any circumstances.

 

Included in your trip

 

All inclusions are set forth in the itinerary and will be made expressly known on the invoice and or itinerary.

 

Special Events

Tickets, admission, entrance to any special event (eg football game, golf, concert, etc.) may require payment in advance and customer will be notified at time of booking.  Customer acknowledges that we are only facilitating the transaction to the special event and any additional terms and conditions related to such events will be expressly between the customer and the event organizer/venue/facility and that we have no control or influence over such transactions.

Admissions, attractions, events, unless specified on your itinerary/invoice

Hotel incidental charges such as telephone, room service, bar, etc. are not included.  Please expect the hotel to request a credit card upon check in for all services not specifically included on your itinerary/invoice.

Air Travel Expense/Charges not included and the responsibility of the traveler

Upgraded seat assignment unless otherwise stated.

Onboard meals, drinks, entertainment, communication services, and other purchases.

Excess baggage fees – please familiarize yourself with the latest baggage charges and exceptions by visiting the website of your airline or requesting a link to the site from your Isle Inn Tours representative.

We are agents only for the airline suppliers we may use to facilitate transportation for your vacation.  We are not liable or responsible for any accident, injury, illness, damage, delay or other loss or expense and you hereby acknowledge that by directing us to purchase air transportation on your behalf that you are entering an agreement directly with the air carrier.

The above are for demonstrative purpose only and do not represent the entirety of items not included in your tour.

 

 

 

Customer/Tour Participant Conduct

By entering this agreement, you acknowledge and accept and agree to be bound by any rules and guidelines established by the tour leader, our representatives/agents, driver, or guide.

We reserve the right to terminate your trip if you are a treat to the comfort, health and/or safety of others, or if your behavior disrupts the peaceful enjoyment of other guests.  No refund will be made should you have to be removed from a trip, and any and all cost associated with such removal will your responsibility alone.

Personal health and safety

You acknowledge and accept that you participate in the activities of the trip at your own risk. Walking, climbing, transiting, and other physical movements may cause harm.  We are unable to evaluate tour member’s fitness for travel, activity, or other participation and we cannot be held responsible for any damages resulting from your choice to join any activity or event.

 

Self-Drive and Car Rental

Certain conditions apply to customers utilizing Hertz Car Rental products and services.  As with all suppliers, you will enter a separate and unique agreement with Hertz at the time you collect your vehicle.  The following guidelines apply to Hertz car rental

Vehicle type/model is not guaranteed and may be listed/suggested as a guide only. Substitutions may be made by Hertz to a similar or upgraded category and any dispute over specific vehicles must be made with Hertz.

Additional insurance may be offered at time of rental and is the sole decision of the renter.  Any/all additional fees for related insurance/services/features/tolls/fuel/damage/parking is the responsibility of the renter.

Driver Age at time of rental must be at least 23 years of age and not more than 80 years of age.  Drivers 76 years of age and older must present a letter from a licensed physician dated less than 30 days prior to rental stating the driver has been in good health for the previous 12 months and in condition to drive safely.  In addition, a second letter issued within 30 days of rental from the renters auto insurance provider must be presented stating the driver has not been in an accident in the previous 5 years and you have current and valid coverage.

 

 

Limited Liability and Arbitration

By entering into this agreement, the customer acknowledges and accepts that we shall not be liable for any incidental or consequential damages and that the sole extent of our liability, if any, shall not exceed the amount actually paid by the customer to us.

Any dispute arising out of or relating to any vacation or transaction shall be submitted to non-binding arbitration under the Federal Arbitration Act.  To the extent that the Federal Arbitration Act either is inapplicable or held not to require arbitration of a particular claim(s) California law pertaining to agreements to arbitrate shall be applied and such arbitration conducted under the terms of the California Code of Civil Procedure.  Each party shall pay for its own costs, arbitration fees, and attorney fees if any.

 

Travelers Needing Special Assistance

We will make reasonable efforts to accommodate the needs of our travelers; however, travelers needing special assistance for their personal needs must notify us at the time of booking for a determination of what assistance we can reasonably provide. In cases where we cannot accommodate a traveler’s special needs, persons requiring this assistance must be accompanied by a companion who will be responsible for independently providing the needed assistance. We regret that we cannot provide special individual assistance to travelers with special needs for ordinary daily activities, such as walking, dining, etc. and other special needs. In no instance will we or our Suppliers physically lift or assist participants on to or off transportation vehicles.
